Online platform operator
Volara operates an online intermediation platform within the meaning of Article L. 111-7 of the French Consumer Code. It connects, on the one hand, pilots, operators holding an air operator certificate, and aircraft owners or lessors, and, on the other hand, persons wishing to book a seat in cost-shared flying, a commercial flight, or the rental of an aircraft. Volara acts solely in the capacity of a technical intermediary. It operates no aircraft, provides no transport, rents out no aircraft, and is neither a carrier, an operator, a lessor, nor an insurer. It is not a party to any transport, cost-shared flying, or rental contract concluded between users through its platform; such contracts are formed directly between the users concerned, who alone bear their performance and consequences. Volara's role is limited to the verification of documents under a best-efforts obligation, the securing of payments through a licensed payment services provider, and the provision of booking, communication, and management tools. This verification constitutes neither a certification nor a guarantee of the services offered by users.
The status of the offerer, whether professional or non-professional, is indicated on each listing, under the responsibility of the person who created it. Pilots offering a cost-shared flight act in a non-professional capacity: cost-shared flying excludes any commercial air transport activity and any profit for the pilot, only the direct costs of the flight being eligible for sharing. Where the offerer is not a professional, the contractual relationship formed with the other user is not subject to the provisions of the Consumer Code protecting consumers, in particular as regards pre-contractual information, warranties, and the right of withdrawal. Commercial flights, by contrast, are offered by professional operators holding an air operator certificate, who are the sole carriers and solely responsible for the performance of the transport. It is incumbent upon each user to take note of the status of the offerer displayed on the listing before making any booking.
Listings are ranked, by default, according to objective and unpaid criteria: firstly, the geographical proximity between the proposed point of departure and the user's search point, then the date of availability, from the nearest to the most distant. Other sorting or filtering criteria may be offered to the user, who is then informed thereof. No remuneration paid by an offerer, and no capital link between Volara and an offerer, influences the ranking or referencing of listings. Volara engages in no paid placement within the results. The main parameters determining the ranking are set out for the user in accordance with Article L. 111-7 of the Consumer Code.
In consideration of the connection service and the services provided, Volara receives a commission. The amount or rate of this commission, together with the total price payable, are displayed clearly before the payment is confirmed, so that the user is aware of them before entering into any commitment. The commission is included in the price paid by the user. The sums corresponding to the pilot's share of costs, to the price of the commercial flight, or to the rental fee for the aircraft accrue to the offerer concerned; only the commission constitutes Volara's remuneration for its intermediary activity. The applicable value added tax is that charged on Volara's commission; it is included in the displayed amount of that commission. The arrangements for payment, escrow, and, where applicable, security deposit are set out in the general terms and conditions of use.
Insurance intermediation
Where this option is offered at the time of booking, Volara distributes a cancellation insurance product in the capacity of an ancillary insurance intermediary within the meaning of the French Insurance Code. This distribution is ancillary to the principal connection activity; the insurance contract is taken out with the partner insurance company, which is the sole insurer, on the terms of the contract that the user is responsible for reviewing before any enrolment. Volara is not an insurer and does not guarantee the risks covered. In this respect, Volara is registered in the single register of insurance, banking, and finance intermediaries maintained by ORIAS. Its registration number appears in these legal notices, and its status may be verified on the website www.orias.fr. The insurance distribution activity is subject to the supervision of the Autorité de contrôle prudentiel et de résolution (ACPR), 4 place de Budapest, CS 92459, 75436 Paris Cedex 09. The guarantees, exclusions, limits, and implementation arrangements of the cancellation insurance product are governed exclusively by the contract taken out and by the insurance company that underwrites the cover.

Any consumer may refer a dispute free of charge to a consumer mediator, after first attempting to resolve it directly with Volara.
